We were very sad to learn of the untimely passing of our colleague and former Fresh partner, Dr. Andy Berks, on February 26, 2025. He passed peacefully surrounded by his family.

Andy was a very kind, friendly, and honorable man, and well-liked and respected by everyone here at Fresh. A patent attorney and partner here until October of 2024, Andy worked primarily in patent prosecution in the life sciences and for industrial applications, pharmaceuticals, medical devices, and engineering technologies, and also engaged in patent licensing and corporate contract work, Hatch-Waxman law and paragraph IV notice letters.

Andy had a law degree from Fordham University and a Ph.D. in Chemistry from the University of Colorado. Prior to joining Fresh, he worked as a scientist at major pharmaceutical companies, as in-house counsel at a generic pharmaceutical company, and as outside counsel at other prestigious firms.

Andy ran Fresh’s New York City office, and split his time between NYC and Fairfield, Iowa, where he studied transcendental meditation. He is survived by his wife Deloria and daughters Jacqueline Berks Falco and Tania Berks, and grandchildren Asher, 2, Michael, 1, and Easton, one month.
