How long does it take for a patent to be approved? Many of our clients are A.I./software companies. This is a rapidly growing space that is becoming very well-funded. However, some potential investors shy away from this space because they falsely believe that software is hard to protect and almost no early stage company has an issued patent.

We therefore see growing demand from our clients to strive to rapid approval.

There are a number of ways to do this and we recently broke a small record with a patent approved in 3 months.

The news have been celebrated by our client and the reaction was powerful. No doubt their investors took note that they have now defensible technology.

How did we get a patent for Exceed.AI so quickly?

In this case, we first used the USPTO’s Track 1 system. Track 1 allows IP owners to request fast processing for a fee, with the aim being to reach a final conclusion of the case within 12 months.

Second, we interviewed the case as soon as it reached prosecution and reached an early agreement with the examiner.

The application has subsequently been allowed and issued.
